The Electronic Courthouse has set standards in a number of areas. These standards are reviewed and updated under our continuous improvement program, of which customer feedback is a central component. Please ensure that you complete your customer Exit Survey in order to contribute to this process. Here is a sampling of the areas in which standards have been developed:

Court-based Mandatory Mediation Programs

 

The Electronic Courthouse complies with Mandatory Mediation Programs mandated by state and provincial Justice Departments and Attorneys General. Our Roster Members are qualified to certify that the parties have completed a mediation session in accordance with the Program requirements.

Legal Advice

 

The Electronic Courthouse does not provide legal advice to its customers. It provides a dispute resolution service to the parties. It is your responsibility to speak to your own independent lawyer to ascertain your legal rights and obligations associated with the dispute. Resolution Professionals do not and can not provide either party with legal advice relating to the dispute at any time during your resolution service. You may search our database to assist you with basic legal information, but this is not legal advice.

Resolution Professionals

 

All our Resolution Professionals, including mediators, arbitrators, evaluators, and subject-matter experts are carefully screened and selected to serve on the The Electronic Courthouse Roster. Unless otherwise indicated, all The Electronic Courthouse Resolution Professionals are lawyers, qualified at prestigious law faculties around the world, with 10 years experience in the practice of law, together with specialized training and a minimum of 2 years applied experience in dispute resolution. They have specialized expertise in the industries, area of law, and subject matters that accord with our customers' disputes.

 

The Electronic Courthouse's Subject-Matter Experts bring highly specialized subject-matter expertise in diverse areas of law relevant to our customers/ disputes, including e-commerce, intellectual property, insurance, the environment, workplace issues and human rights. Subject-Matter Experts may assist your Dispute Resolution Professional, should highly specialized legal or subject-matter expertise be required.

 

Once selected to serve on our Roster, all Resolution Professionals and Subject-Matter Experts are again carefully screened in accordance with 10 pre-determined criteria to form a short list of expert resolution professionals from which the parties may select. These criteria are set out under Selection Process on our Web site.

 

Customer feedback about our resolution professionals is provided by all customers at the end of each resolution session and is a central component in our vigilant quality control program.

Rules of Engagement

 

The Electronic Courthouse uses the Rules, often referred to as the Rules of Engagement, established by leading not-for-profit arbitration associations around the world. We are able to adopt and apply the Rules provided for in your industry association or commercial contract. Our arbitrators are trained and experienced in applying these rules. The parties may agree to amend these rules where such an amendment is ethical, fair, and is agreed to in writing by the parties.
